Welcome to the Palmetto Wine Co. website (the “Site”). By accessing or using the Site, you agree to comply with and be bound by the following Terms of Use. If you do not agree to these terms, please refrain from using the Site.

TERMS & CONDITIONS
By using this Site, you signify your acceptance of these terms and conditions. Palmetto Wine Co. reserves the right to modify, update, or amend these Terms of Use at any time without prior notice. Your continued use of the Site following the posting of any changes signifies your acceptance of those changes.

AGE RESTRICTION
It is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years. By agreeing to our terms and conditions, you are providing verifiable proof you are of legal age. Palmetto Wine Co. reserve the right to request identification prior to and/or upon delivery of your product. Access to this Site is restricted to individuals 18 years of age or older. By using this Site, you confirm that you are of legal drinking age in your country or state of residence. If you are not, please exit the Site immediately.

All content on Palmetto Wine Co. is held under copyright by Palmetto Wine Co. P/L and is protected under Australian law. Content from publications and suppliers outside of Palmetto Wine Co. used under license, may not be reproduced without written consent from Palmetto Wine Co. P/L. Acceptable use of content may apply for original content displayed on Palmetto Wine Co. in unaltered form for non-commercial use.

CURRENCY
All prices quoted on this website are in Australian Dollars. All prices listed are GST inclusive.

USE OF THE SITE
You may use the Site for personal, non-commercial purposes only. You agree not to engage in any activity that may:

Disrupt or interfere with the functioning of the Site.
Violate any applicable local, state, national, or international laws.
Infringe upon the rights of others, including their intellectual property and privacy rights.

ERRORS AND OMISSIONS
Whilst every care is taken to provide information that is valid, clear and accurate at time of publication, Palmetto Wine Co. acknowledge that errors may occur. As specials, policies, price points, dates, conditions, and information are continually changing, Palmetto Wine Co. reserve the right to revise our content at any time to ensure the information we provide to all customers is as accurate as humanly possible. We offer no warranty or guarantee on information found to be containing errors or omissions.

PURCHASING AND SHIPPING
All purchases made through the Site are subject to our Terms and Conditions of Sale. By placing an order, you agree to be bound by those terms. Palmetto Wine Co. complies with all relevant Australian alcohol sale and distribution regulations. All sales are final, and Palmetto Wine Co. reserves the right to refuse or cancel any order at its discretion.

Palmetto Wine Co. reserves the right to end promotions at any time. Coupon codes cannot be added retrospectively or after order processing. Coupons mistakenly not applied at checkout may be issued as a store credit at Palmetto Wine Co. discretion.

In order to guarantee the safe delivery of our wines, Palmetto Wine Co. has implemented an extreme weather delivery policy. If extreme weather conditions are present either at our warehouse or at the wine's final destination, we will not ship the wine. In such cases, we will contact the customer to arrange a suitable delivery time when the wine will not be at risk.

Palmetto Wine Co. will not deliver to any area deemed a dry zone under Australian law. Please do not attempt to order to these areas as they will be refused.

Due to Liquor Licensing laws, we are currently unable to sell internationally. Orders can only be shipped within Australia.

RETURNS
All refunds will be transacted within 30 days of Palmetto Wine Co. being notified and confirmation that the wine has been returned in saleable condition. If you’re returning an item that was discounted or bundled, you will not receive the total price of that individual item. Instead, the refund amount will be adjusted accordingly.

An order may be adjusted or cancelled at the discretion of the Palmetto Wine Co. team if reasonable notice is given prior to dispatch. Once the wine is dispatched, it may be recalled or redirected by the customer or upon request to Palmetto Wine Co. to act on the customer's behalf. No refunds or credits can be given until the warehouse receives the original wine. If Palmetto Wine Co. has been notified of a breakage in transit by our carrier, we will endeavour to send out a replacement to the customer as soon as possible.

We will replace or refund you for any bottle of wine that is received damaged or faulty. We ask the customer to return the unfinished portion of the original bottle for replacement. By law, we cannot accept returns of alcoholic beverages unless the product is corked or damaged. We are also unable to accept returns of wines that were damaged due to adverse weather conditions during shipment or wine that was ordered in error.

Once the wine is received back at the warehouse, we will refund your credit card account for the cost of the wine, less shipping and handling. If the original shipment was damaged or flawed, you will receive a full refund, including shipping and handling charges.

Content within Palmetto Wine Co. may contain links to external sites. Palmetto Wine Co. accepts no responsibility for content published on external sites, and accepts no liability for the content of any linked provider.

INTELLECTUAL PROPERTY
All content contained within the Palmetto Wine Co. site, it’s marketing collaterals both online and offline, graphics, logos and bottle shots are subject to copyright owned by Palmetto Wine Co. and its suppliers/licensors and are protected by the laws of Australia governing copyright and intellectual property ownership.

Copyright of content provided under license to Palmetto Wine Co. by third parties, is owned by that third party and may not be reproduced without permission from said third party. It is not permissible to reproduce any content from Palmetto Wine Co. or any of the aforesaid IP for commercial, educational or private use without express permission in writing from Palmetto Wine Co. Any improper use as defined under copyright law is strictly prohibited and will be prosecuted.

PASSWORD SECURITY
Password security is the sole responsibility of the Palmetto Wine Co. visitor and member. Palmetto Wine Co. accept no responsibility for access gained by others to your personal information, including but not restricted to information pertaining to your identity or credit card, through the owner of these details not exercising reasonable caution and security against theft or misuse. It is the responsibility of visitors to the website to ensure the privacy of their own password. Palmetto Wine Co. encourage our members to change their passwords on a regular basis, and to use alphanumeric combinations.

PRICING ERRORS
In the event of a product inadvertently appearing on the website at the wrong price, Palmetto Wine Co. reserves the right to cancel or decline orders for the product at the incorrect price.

GOVERNING LAW
These Terms of Use are governed by and construed in accordance with the laws of the state of South Australia, Australia. You agree to submit to the exclusive jurisdiction of the courts in South Australia or the resolution of any disputes arising from these Terms of Use or your use of the Site.

TERMINATION
Palmetto Wine Co. reserves the right, in its sole discretion, to terminate your access to the Site at any time without notice for conduct that we believe violates these Terms of Use or is otherwise harmful to the interests of Palmetto Wine Co. or other users.
